Yeah that whole Tobey suit thing isn't a continuity error. If the suits were identical, THEN it would be a continuity error.

I mean, wasn't the suit beaten up and torn at the end of Spider-Man 3? Exactly. Add to that: when he enters the MCU he refers to fighting an alien of black goo once, speaking of it as past tense, meaning he was transported to the MCU long after the events of Spider-Man 3, by which time he most logically would have crafted a new suit that isn't damaged to continue the crime fighting. So it would actually make less sense for the suits to be identical.

But in retort I will offer a better continuity error from Spider-Man: No Way Home involving the way a certain character is dressed: Doc Ock's appearance at the end of Spider-Man 2 (from where he was taken) : Doc Ock's first appearance in No Way Home:
